While the public rightly expects answers as to who is to blame for the tram accident in which a young man, Erdoan Morankic, was killed, and a 17-year-old girl was seriously injured and her leg was amputated, the report reveals that in May of last year, the KS Prosecutor’s Office forwarded to POSKOK two cases related to reported crime in GRAS.
Both cases were before the indictment, but with the establishment of POSKOK, the Prosecutor’s Office of KS sent them to the Special Department of POSKOK for processing due to the jurisdiction and the criminal offense.
Clear competence of POSKOK
The report learns that it is a complaint against the former leaders of GRAS, Avda Vatrić and Jakub Kubur.
Namely, according to the information of the Report, the Cantonal Prosecutor’s Office of the Canton of Sarajevo in criminal case number: T09 0 KTK 0157143 23 acted on the verification of allegations related to illegalities committed during the implementation of the Public Procurement procedure for equipping and building tram stops with a total value of 7,115,064.41 KM, all in order to determine the existence of the criminal offense of Abuse of position or authority.
This case was transferred to POSKOK for processing in May, and the reason is the conclusion from the session of the Extended Collegium of Chief Prosecutors of the Federation of Bosnia and Herzegovina, where the Cantonal Prosecutor’s Office is not actually competent in this criminal matter. The Prosecutor’s Office of Sarajevo Canton, first of all, considered the question of jurisdiction, and determined that it was not competent, and handed the case with all the files to POSKOK.
But that’s not all. Another item has been sent. And a very serious one that ended with the report of the KS MUP.

The suspects in the criminal case, as reported by Raport, are Avdo Vatrić and Jakub Kubur, the former general directors of KJKP “Gras” doo Sarajevo, and due to the existence of grounds for suspicion that they have committed the criminal offense of Abuse of position or authority from Article 383, paragraph 3 in connection with paragraph 1 of the FBiH CC and Conclusion of a harmful contract from Article 252, paragraph 2 in connection with paragraph 1 of the FBiH CC.
The subject of the investigation is the procurement procedure of 14 used trolleybuses carried out by KJKP “GRAS” doo Sarajevo during 2019.
Namely, it follows from the collected evidence that the legal entity GN Company doo Tuzla, with which KJKP “GRAS” concluded two sales contracts for seven used trolleybuses in January 2019 and for an additional 7 trolleybuses in December 2019, imported 17 used trolleybuses during 2019, the individual net value of which is approximately 11,000.00 KM, while the value of both is sales. contract, concluded between KJKP “GRAS doo Sarajevo and GN Company doo Tuzla, amounted to 1,400,000.00 KM without VAT.
Had customs declarations
The management of “GRAS” had customs declarations for 7 previously acquired trolleybuses, from which it is clear that the purchase value of one trolleybus was approximately 11,000.00 KM, while “GRAS” paid 100,000.00 KM in the procurement process for one trolleybus, i.e. at a price 10 times higher than the purchase price, how did it benefit the legal entity GN Company doo Tuzla and damage the legal entity “GRAS” for an amount greater than 100,000.00 KM, it is stated in the documents of the KS Prosecutor’s Office, which the Report had access to.
