After several months of public discussion, the Law on Mediation in Employment and Social Security of the FBiH will be discussed at the next session of the House of Representatives of the FBiH Parliament. Its maintenance is planned for March 11 and 12.
Judging by the provisions of the new law, which the Government of the FBiH treats as an important reform in the field of employment, a kind of emptying of the employment bureau in the FBiH is planned.
Active and inactive
Namely, the provisions of this law first prescribe when an unemployed person is considered to be actively looking for a job, and when the employment service stops keeping records of a person as unemployed.
In addition, it is stipulated that unemployed – inactive persons are considered to be persons who are not actively looking for work, are not available for work and who do not meet the conditions prescribed by this law. Then the employment service stops keeping it in the records.
Thus, according to Article 6, the employment service will stop keeping records of a person as unemployed if he refuses two consecutive employments within the scope of the acquired title, that is, occupation and work experience without a justified reason.
Furthermore, a person whose actions cause the employer to refuse employment, “unless he refuses employment for the reason that the employer regularly does not fulfill his obligations) will also not have rights at the bureau. The same as a person who is caught working by the competent inspection without an employment contract.
Data from the Federal Institute
With Article 23, the FBiH Government is trying to “force” employment services to collect data on the labor market situation on a daily basis, and to communicate with employers in order to collect information about job vacancies.
Thus, according to this article, the Employment Service will be obliged, in the event that the employer requests mediation, to advertise the need for workers on its notice board and website within three days from the date of submission of the application, and undertake the necessary activities to find a suitable person from the register of unemployed persons, for the purpose of employment with the employer.
By the way, according to data from the Federal Employment Agency, more than 37 percent of people have been unemployed for more than eight years on the records of employment services in the Federation.
One of the key problems facing the labor market in FBiH is the imprecise registration of the unemployed.
However, in the new law, benefits for the unemployed are also established and amount to 40 percent of the net salary paid in the FBiH in the last three months, it says Focus.
