More than a year has passed since the Court of Bosnia and Herzegovina issued a final judgment on the lawsuit filed by five employees of the Center for the Removal of Mines in BiH (BHMAC), confirming their right to benefited work experience, but this judgment has not yet been implemented.
BHMAC did not answer the question why it was not implemented and when they intend to do it, while the BHMAC Union offered us the explanation they were receiving.
– It took them a year to find out the code for benefited work experience at the FBiH PIO Institute. Their reasoning is that it was difficult for five people who received a final verdict, and there are about 80 of them, to change that decision – said the Syndicate.
They said that the final judgment was passed on January 14 of last year and that this time is being “washed”.
– We are the expert body of the Demining Commission. Our boss is the Ministry of Civil Affairs of Bosnia and Herzegovina. The director of BHMAC (Enis Horozović) said that he could not make a decision on his own, the President of the Commission the same – the union added.
They pointed out that it is a paradox that the money for those contributions for five people actually exists, but…
– The man who retired before the verdict receives a reduced pension for one year, and the treasury paid money for those people who were in court into an account of the PIO Institute. However, the PIO cannot use it because it needs to go by first and last name and for the exact amount of money for five people – explained the Union.
The fact that this verdict on the lawsuit of five employees is the first and has opened the door for new mass lawsuits carries special weight. The proceedings against the lawsuits of another 44 former and current employees of BHMAC on the same basis are ongoing and the verdict is expected to be the same as the first one, after which it is expected that about a hundred more people will sue.
When this was understood, the Council of Ministers of Bosnia and Herzegovina received and adopted at its session on Wednesday information about the lawsuits filed and the judgments passed by BHMAC employees regarding the benefited seniority. At the same time, the Office of the Attorney General of Bosnia and Herzegovina is tasked, in cooperation with BHMAC and the Ministry of Finance and Treasury of BiH, to examine the merits of entering into settlements in active and potential future court proceedings, in order to reduce the costs of court proceedings, and to submit to the Council of Ministers of BiH a reasoned proposal for resolving the dispute.
– We don’t know how all of this will be resolved, whether everyone will be paid for their seniority or whether they will be employed by people who are close to retirement. They themselves don’t know that either – added the BHMAC union.
Employees and former employees of BHMAC filed lawsuits against Bosnia and Herzegovina, the Ministry of Civil Affairs, the Commission for Demining and BHMAC, with the aim of recognizing the right to benefited seniority, four months of additional seniority for each year of work, and the payment of contributions based on that right.
The financial effects of the final verdict for five people are 100,032.40 KM in the name of contributions and 8,502.12 KM for the costs of the procedure. The remaining nine lawsuits (44 people) carry a potential financial burden of approximately 630,000 KM, not including the costs of procedures and expert analysis, it says. Factor.
