The Federation of BiH has been functioning without a law more than a decade that should prevent conflicts of interest.
The last attempt to change was failed in the spring 2023. year, when the draft law on the prevention of conflicts of interest was withdrawn from the parliamentary procedure.
Since then, the FBiH government did not send a new proposal, which opened space for officials to remain smoothly in conflict interest because there is no body to sanction them.
Namely, in the draft that has been drawn, it is defined that the employment of relatives in the same authority in which the holder of the public office performs direct supervision by direct supervision the conflict of the interest of the public office holder.
It is further stated that the public office holder must not use its position for the privilege of persons in employment and achieving their other rights from employment status.
The problem with the existing law is that the conflict of interest in FBiH has no one to sanction because the body that would apply this federal law, after the government law has been changed, when the central election commission (CEC) BiH has been lost.
The new law should, among other things, to treat this question, but it is not yet.

Our officials have been no problem for 12 years, very often in the conflict of interest, the penalties for this is not, and the European Commission has long given their opinion – concludes Purić.

Fahrudin Skopjak, the SDA representative in the Federation of BiH, says that it is important to adopt regulations that will prevent conflicts of interest, but that no matter the Ministry of Justice and the FBiH government is not yet going to the law before parliament.
– It is a long period of time, for more than ten years in the FBiH, there is no problem in the FBiH, there is a big problem, a lot of officials are in the conflict of interest.
