The ruling is likely the second Trump administration’s most significant defeat before the conservative-majority Supreme Court. Last year, in a series of urgent decisions, the court repeatedly sided with the president in cases related to immigration, the dismissal of heads of independent agencies and deep cuts in state spending.
The majority opinion, with six of the nine justices concurring, was written by Chief Justice John Roberts. The explanation states that the tariffs are illegal because Trump exceeded his authority with them.
“The president arrogates to himself extraordinary authority to unilaterally impose tariffs of unlimited amount, duration, and scope,” Roberts wrote on behalf of the court.
“Given the scope, history, and constitutional context of the authority invoked, it must indicate clear congressional authorization for its exercise.”
The court concluded that the extraordinary power that Trump tried to invoke “is not sufficient.”
