The American District Judge Charles Breyer from San Francisco issued an order in the IMA District Court of the Northern District of California. He postponed the decision to force until 12. September. Trump administration is expected to complain, Reuters writes.
In June, Trump ordered the allocation of 4,000 members of the National Guard and 700 active Marines in Los Angeles, in response to protests against large immigration raids in the second largest American city.
The move has strengthened tensions in the city and caused convictions of the Democrats, who claimed that Trump used the army to suffocate opposition to its immigration policy. The case opened new legal issues on presidential powers.
The lawsuit filed by Gavin News, prominent Democrat, she stated that the arrangement of the army violated many American standards and the law known as the Law on Federal Army for the internal application of the law.
In his opinion, Breyer stated that the evidence was shown that Trump administration used soldiers and military vehicles to establish protective perimers and traffic blockage.

The Trump Administration receded that the U.S. Constitution allows the Presidents to the use of the Army for the Protection of Federal Staff and Properties, as an exception to the Law on Posse Comitatus.
