Will pensioners in the Federation of BiH be retroactively paid the July increase in pensions, is a question that is being asked more and more often after the new Law on MIO introduced adjustment twice a year, on January 1 and July 1. According to the current law, starting in 2026, pensions are adjusted precisely on those two dates, and every subsequent adjustment, starting on July 1, 2026, is carried out ex officio on the basis of official statistical data from the Federal Bureau of Statistics.
This practically means that the July increase should not be a “voluntary” or subsequent decision, but a legal obligation that applies from July 1. However, the law does not explicitly prescribe the wording “retroactive payment of the July difference”, but stipulates that the adjustment is made from July 1, while in the event that official statistical data are not known at the time of making the decision, the insurance carrier can make a decision on advance adjustment of pensions.
This is precisely where the answer to the pensioner’s dilemma lies. If all statistics are known in time and a decision is made before the July pension is paid, the increased amount could be paid immediately. If the data is not completed on time, it is possible that the advance payment will be paid first, and that the difference after the final calculation will be paid later for the period from July 1. Such a model was already applied this year in the January adjustment, when the Federal Institute of MIO announced that the difference between the advance and final adjustment will be paid with the February pension.
Therefore, on the basis of the current law and the current practice from 2026, it can be concluded that any difference in the July adjustment would be calculated from July 1, i.e. that pensioners should not be left without part of the increase that is due to them by law from that date. However, at this moment there is no official decision of the Federal Institute of MIO/PIO that would specify how the July adjustment will be technically carried out and whether the difference will be paid in the same or the following month.
For users who became eligible by January 1, 2026, the lowest pension is currently 666.76 KM, guaranteed 795.74 KM, while the highest is 3,333.79 KM. For those who exercise their right after January 1, 2026, the basis for calculating the lowest pension is 724.36 KM. Thus, the lowest pension amounts to 434.62 KM for less than 20 years of service, 470.83 KM for 20 to 25 years of service, 507.05 KM for 25 to 30 years of service, 543.27 KM for 30 to 35 years of service, 615.71 KM for 35 to 40 years of service, and 688.14 KM for users with 40 and more years of experience. The guaranteed pension for new beneficiaries with 40 or more years of insurance experience is 842.44 KM, while the family and disability pension for beneficiaries who exercise their right after January 1, 2026 cannot be lower than 651.92 KM. In other words, the July increase under the new law exists and is related to July 1, but the answer to the question of whether it will be paid immediately or later will depend on the dynamics of the publication of statistical data and the decision of the Federal Institute of MIO/PIO.
