How to retire if I miss my work experience? This question is increasingly placed by persons who are in advance of meeting years of age, but they lack several years of service to achieve the right to an old-age pension.
FBiH has a solution for such cases, which is prescribed by Article 31. Law on Mediation in Employment and Social Security of Unemployed.
Legal provision
According to the law, the unemployed person lacks up to three years of experience has the right to be paid by pension and disability insurance, all the way to fulfilling conditions for an age, early or more favorable pension. This right does not occur automatically, but is achieved under certain conditions, with delivery of documentation to the competent services.
The aim of this legal provision is that for people who have been working for years, but for various reasons have failed to achieve full internship, enable dignified retirement. This is especially true for people who have lost their jobs in the lesson years of life, when it is difficult to find new employment.
In order for someone to achieve this right to a pension, he must be reported as unemployed in the records of the competent employment bureau and must not have more than three years left over to the right to retire. It is important to emphasize that this right also applies to special categories such as war invalids, participants in the armed forces of RBiH, wins of war recognitions and decorations, as well as members of their families.
Documents needed to be submitted include a workbook, certificate from the parent record (Form AM), unemployment certificate, as well as war engagement certificates if applicable. For those who do not have a workbook, it is possible to give a statement under full responsibility.
If the unemployed person has the status of war invalid, then the decision is further accompanied on the recognition of that status, as well as certificates from the municipal service for veteran-disability protection. If applied for more favorable retirement based on the defense experience, the certificate of the Ministry of Boračka issues on the special form of the CAP.
Those who have achieved and beyond the Federation, e.g. abroad or the PIO of the Republika Srpska Fund, must submit certificates of these periods of work to be included in the total pension service. In addition, written consent is also needed to be included in a special internship.
