Citizens of the Federation of BiH who acquired the conditions for retirement between January 1 and January 23 retired according to the amendments to the Law on Pension and Disability Insurance, which were confirmed by the House of Peoples of the FBiH Parliament only on January 23, and the law is applied retroactively from January 1.
So, at the moment when they submitted the request for retirement, the old law was in force, because the changes were only adopted on January 23, but they went according to the amended law, because when it was adopted, it was said to be applied retroactively, from January 1.
– The Federal Institute, as a public institution that implements regulations in this area, is obliged to apply the Law as adopted by the legislator, i.e. from January 1, 2026 – it was stated from the Federal Institute for Pension and Disability Insurance.
At the proposal of the Federal Ministry of Labor and Social Policy, the FBiH Parliament also adopted amendments to Article 81, which refers to the lowest old-age pensions, which introduced pensions lower than the lowest, which was copied from the smaller BiH. entity of the RS.
Now, a person who, for example, had 15 years of service and 65 years of life, and in all those 15 years the average salary in the Federation, will have a pension of 434 KM. Those with 20 years of service and less than 25 years of service will have 470 KM pension, and all those who have had 25 years of service and more and less than 30 years will have 507 KM.
According to the old law, they would have a higher pension, which would not be lower than the lowest, which is now 666.76 KM.
And that’s not all, if you didn’t have an average salary for all those years, then you won’t get a point for each year at retirement. If your salary means half a point per year, then for 15 years of service and 65 years of life you can expect a pension of 197 KM.
Because of all this, a group of representatives in the House of Representatives of the Parliament of the Federation of BiH requested an evaluation of the constitutionality of Article 81 of the Law on PIO and its retroactive application by the Constitutional Court of FBiH.
– In the period from January 1 to January 23, 2026, a total of 1,995 users were registered who were entitled to a pension in accordance with the Law on Pension and Disability Insurance. Of these, 197 beneficiaries were entitled to a pension with up to 20 years of service. The most significant amendment to the Law, which applies from January 1, 2026, refers to Article 81, which regulates the lowest, guaranteed and highest pension.
That amendment prescribed as many as six categories of the lowest old-age pension, whereby the categorization was made on the basis of the length of the completed pension period. The changes did not bring about changes in the method of calculating the amount of the pension, but are reflected in the provision of several types of the lowest pensions – and only in cases when the pension calculated on the basis of seniority and paid contributions does not reach the amount of the lowest pension.
