Judge William Alsup has made this decision in San Francisco, and she refers to the Ministry of Defense, Ministry of Veterans, Ministry of Agriculture, Ministry of Energy, Ministry of Internal Affairs and Ministry of Finance.
Last month, Alsup has temporarily blocked the Human Resource Management Office (OPM), which oversees the Federal Agencies, to order the dismissal employees on probation. However, then he did not decide on their return to work.
Employees on a trial work usually have less than a year of work experience, although some of them are long-term civil servants.
They have a smaller job protection compared to other state workers, but as a rule can be released only due to poor work performance.
Judge Alsup has now ruled that OPM has no power to order dismissals and that there is evidence that the cancellations in six ministries are illegally ordered.
However, he did not oblige the remaining 16 ministries, which are also listed in the lawsuit of trade unions and non-profit organizations, to return fired workers.
– It’s a sad day when our government is firing a good worker and claims that it is due to work performance, and they know very well that it is a lie – said Judge Alsup.
The proportions of the Trump campaign of reducing the federal bureaucracy could become clearer today, when the deadline for state agencies will provide plans for the second wave of mass release and budget cutting.
