The Communications Regulatory Agency (RAK) announced that their Council at today’s session approved public consultations on the Draft Rule on the public electronic register “Do Not Call”.
As they reasoned, within the framework of harmonizing the domestic regulatory framework with the legal acquis of the European Union in the field of electronic communications and protecting the privacy of users of electronic communication services, especially in the part of protecting users from unwanted communications for the purpose of direct marketing, the need to establish a register of telephone numbers of users who do not want to receive such calls was recognized.
They noted that this area is regulated at the EU level by the Directive on Privacy and Electronic Communications, which regulates the use of electronic communications for the purpose of direct marketing, and by the EU regulation, which establishes general rules for the protection of personal data and the rights of individuals in connection with the processing of their data.
In practice, this means that EU countries establish a special register of telephone numbers of users who do not want to receive calls for the purpose of direct marketing (so-called “Do Not Call” registers).
Such systems allow consumers to, as the RAK pointed out, express their will in a simple way that they do not want to receive commercial calls, while those engaged in direct marketing are enabled to check the status of phone numbers before making a call.
The legal basis for the adoption of the new Rule is based on several individual regulations at the level of Bosnia and Herzegovina, in the field of electronic communications, personal data protection and consumer protection.
The Council of the Agency set a deadline of 30 days for public consultations on the draft of the mentioned by-law.
At the session, the Council of the Agency determined the budget framework of the Agency for the next medium-term period, adopted the report for the fourth quarter of last year, considered the annual report on the work of the Agency for 2025, as well as several individual pieces of information from its jurisdiction, writes Klix.
