One of the frequent questions that citizens ask the Federal Institute for Pension and Disability Insurance is under which regulations a pension can still be obtained, in addition to the Law on Pension and Disability Insurance.
As stated by the PIO Institute, one of those regulations is the Law on Premature and Favorable Retirement of Defenders of the Defense and Liberation War.
They must be at the bureau for one year before retiring
– It is stipulated that members of the Armed Forces of the Republic of Bosnia and Herzegovina (ARBiH, HVO, MUP of the RBiH…) who have been recognized for participating in the defense of Bosnia and Herzegovina for at least three years and who have not deserted, are exceptionally entitled to an old-age pension in the amount the lowest pensions paid for that month in accordance with the Pension and Disability Insurance Act and before reaching the age of 65, provided that they have at least 20 years of pensionable service and are at least 12 months before submitting the request for retirement, according to this law, were on the records of the Employment Service – they state, among other things, from the PIO Institute.
A pension can also be obtained according to the Law on Service in the Armed Forces of Bosnia and Herzegovina.
– The Law on Service in the Armed Forces of Bosnia and Herzegovina prescribes, among other things, the conditions for recognizing the right to old-age pension, early old-age pension, disability and family pension, for military insured persons. A military insured is entitled to an old-age pension when he reaches the age of 55 and has at least 30 years of pensionable service. Then, he becomes entitled to an old-age pension when he reaches 40 years of pensionable service, regardless of his age – it is stated.
It is also possible to retire according to the Law on special rights of winners of war awards and decorations and their family members.
– The conditions for exercising the right under this regulation are regulated by Article 13 of the Law, in such a way that the recipient of a war award or decoration from Article 2, paragraph 1 of this law acquires the right to a full old-age pension upon reaching 35 years of pensionable service, regardless of age of life, i.e. the right to an old-age pension when he reaches the age of 55 and has at least 15 years of pensionable service, under the conditions and in the manner prescribed by the Act on Pension and Disability Insurance – they stated.
War invalids and full old-age pension
A pension can also be obtained based on the Law on the Rights of Veterans and Their Family Members.
– It is stipulated that members of the armed forces who, under the conditions and in the manner established by federal regulations, have achieved the status of war disabled military, and who have been determined to be incapable of earning, solely as a result of damage to the body due to a wound, injury or illness, on the basis of which they achieved military disability. Then, those who have been recognized with a special seniority in double duration and who were not insured at the time of joining the armed forces, have the right to a disability pension, under the conditions prescribed in the Law on Pension and Disability Insurance – explained in the Institute of PIO FBiH.
It is stipulated that disabled war veterans acquire the right to a full old-age pension upon reaching 35 years of pensionable service, regardless of age, i.e. the right to an old-age pension when they reach the age of 55 and at least 15 years of pensionable service, under the conditions and in the manner prescribed by the Law on pension and disability insurance.
