When the driver receives a misdemeanor order due to the speed overdraft, many wonder what the deadlines should be reacted exactly. This document is issued by the police, means that the driver was initiated by the misdemeanor proceedings, and that it was made to be fined and if necessary, an additional measure of confiscation of points or driver’s license.
The misdemeanor order must contain basic data on the driver, time and place of violation, measured transgression of speed, legal article that has been injured, and the amount of the driver’s right and instructions. The order is submitted by mail, and according to the Law on Federation of the Federation of BiH, it is considered that the fifth work day from the day the police authority has submitted to the post office.
Once the order arrives, the driver has two options. It is the first to accept responsibility and pay the penalty within the specified time, which ends the proceedings. In some cantons, it is possible to impair the penalty if the payment is made in a short time, most often eight days from admission.
Another possibility is to file an objection and ask for judicial decision. This is done by signing a copy of the misdemeanor order and submit a copy of the misdemeanor order for eight days. The Court then schedules a hearing, on which the driver can declare, present evidence and challenge the police allegations. If the Court finds that the order is issued without a legal basis or with procedural errors, it can be undone.
