The Supreme Court of the Federation of Bosnia and Herzegovina accepted the appeals of the defense on the determination of injunctive measures in the case “Munjić and others”, which will then be returned to the judge for the preliminary proceedings for a new decision. The reasons for this are formal, not substantive.
As the defense lawyers Sanin Pešto and Alena Begović confirmed to us, the decision of the judge for the preliminary proceedings, which determined the prohibition measures against Vahidin Munjić, Muhamed Ohranović, Arijana Huseinović Ajanović and Ervin Mušinović, was revoked.
They were banned from performing official duties and meeting with each other on November 14 after a hearing held in POSKOK, and on suspicion of having committed criminal acts: Abuse of official position or authority, Giving a reward or other form of benefit for trading in influence and Receiving a reward or other form of benefit for trading in influence, that is, Huseinović Ajanović and Mušinović are suspected of the criminal offense of Receiving a reward or other form of benefit for trading in influence.
The lawyers of the suspects also emphasized that the case is being returned for retrial, and Pešto explained to Klix.ba the reasons for the cancellation of the original decision and the retrial.
“Based on a preliminary review of the Decision, we determined that in the decision on the appeal, the Extrajudicial Panel, among other things, pointed out the absence of a court decision on part of the objections of the defense presented at the hearing for the determination of injunctive measures, as well as the evaluation of the evidence that the defense introduced into the file at the hearing held before the judge for the preliminary proceedings,” Pešto said.
Therefore, in the new decision, the judge should include the explanation (evaluation) of the evidence, which was omitted, and correct the violations of the process.
Judging by the explanation of the decision to revoke the original decision, this means that the reasons for the abolition of the prohibition measures are of a formal and not essential nature, and it can be expected that, after the procedural errors have been corrected, the judge will re-introduce the prohibition measures to the suspects Munjić, Ohranović, Huseinović Ajanović and Mušinović, writes Klix.
