At the 51st session of the Constitutional Law Commission of the House of Representatives of the Parliamentary Assembly of Bosnia and Herzegovina (PSBiH), a number of legal solutions were considered, and the key decision refers to the adoption of amendments to the Law on Identity Cards and the Criminal Code of BiH.
In the second commission phase, the Constitutional Law Commission, along with two adopted amendments, supported the Proposal of the Law on Amendments to the Law on the Identity Card of Citizens of Bosnia and Herzegovina.
We would like to remind you that the proponents of this legal solution, which is being considered according to the abbreviated legislative procedure, are MPs Saša Magazinović and Denis Zvizdić.
In addition, the Proposal of the Law on Amendments to the Criminal Code of Bosnia and Herzegovina, whose proponent, also under abbreviated procedure, MP Branislav Borenović, received support in the second commission phase, along with one adopted amendment.
Without support for the Law on Administrative Property and the Report of the Council of Ministers
On the other hand, the proposal of the law on the management of administrative assets of Bosnia and Herzegovina, proposed by MP Jasmin Imamović, did not receive the green light from the commission.
In this case, the Commission did not establish compliance with the Constitution and legal system of BiH, nor did it support the very principles of the proposed law.
The members of the Constitutional and Legal Commission also did not support the Report on the work of the Council of Ministers of Bosnia and Herzegovina for the year 2025.
Considered requests of the Constitutional Court of BiH on salaries and administrative disputes
At the session, two specific requests of the Constitutional Court of Bosnia and Herzegovina were discussed, which refer to the assessment of the compatibility of certain legal provisions with the Constitution of Bosnia and Herzegovina and the European Convention on Human Rights.
The first request concerned the assessment of the constitutionality of Article 11 (salary grade B6) of the Law on Salaries and Remuneration in Institutions of Bosnia and Herzegovina, which applies to prosecutors. The second request referred to the compatibility assessment of Article 19, paragraph 1 of the Law on Administrative Disputes of Bosnia and Herzegovina.
In connection with both requests, the Constitutional Law Commission stated that the Parliamentary Assembly of BiH passed the mentioned laws, and that the final decision on these disputes will be made by the Constitutional Court of BiH, it was announced from the Public Relations Department of the PSBiH, it says Acts.
