Rulebook amended: Discrimination abolished, how expenses are reimbursed in the event of the death of the pensioner

In the Official Gazette of the Federation of Bosnia and Herzegovina, changes to the Rulebook on reimbursement of expenses in the event of the death of a pensioner were published.

The changes consist in the deletion of article two, which was actually discriminatory and stated that families of pensioners who lived in the FBiH and Brčko District have the right to posthumous benefits. Now the families of pensioners who lived in the smaller Bosnia and Herzegovina are entitled to death benefits. entity of the RS, and received a pension through the Federal Institute for Pension and Disability Insurance.

In May of last year, the Constitutional Court of Bosnia and Herzegovina determined that the Law on Pension and Disability Insurance in the article concerning the payment of death benefits is not in accordance with the European Convention on the Protection of Human Rights and Fundamental Freedoms. More precisely, that it is not appropriate that death benefits are paid to the families of deceased pensioners who lived in the territory of FBiH, Brčko District, and that they are not paid to the families of deceased pensioners who received pensions from the Federal Institute for Pension and Disability Insurance, but lived in the area of smaller bh. entity of the RS, it says Factor.

Article 9 was also amended in the Rulebook, which concerns the documentation that must be submitted when requesting death benefits.

– The marriage certificate must be attached to the application when the application is submitted by the spouse of the deceased. Then, the corresponding legally binding court decision establishing the status of the common-law partner with the indicated legal validity clause.

It is necessary to submit proof of kinship with the deceased pension beneficiary when the request is not submitted by the spouse but by another member of the immediate family. It is necessary to submit a power of attorney if the request is submitted by proxy. Then submit funeral expense invoices issued by a legal entity registered for funerals and related activities.
