When in June this year, the Department for the implementation of the Procedure on the HJPC reports began, the process of collecting property cards for 2023 was also begun. And 2024. year. The deadline that was then determined was three months.
Almost three months after, Sanin Bogunić, president of the High Judicial and Prosecutorial, states that he hopes his colleagues in the judiciary will comply with the deadline.
“We have the announcements that this deadline will be respected. Unrelanding the property would be a disciplinary offense,” Bogunić said, adding that over 100 reports per day is currently submitted.
He stated that the property of half of the officials of the judicial functions that are members of the Council has been checked so far. The Council consists of 15 members.
The enthusiasm of Bogunić for the submission of property cards does not share other members of the Council as they discussed the publication of property cards members who are not judges and prosecutors.
Lawyer Davor Martinović said the publication of property records presented as a standard of the European Union, and that he made an analysis according to which property records are not published in 17 states, while there are restrictions.
He said he believes that the proposal he sent with colleagues from the Council, who were not judges and prosecutors, should be accepted. Martinovic and his colleagues do not want their property records to be publicly revealed.
Aleksandra Obradović, a member of the Council, states that the exception cannot be made because the amendments to the Law on HJPCs from 2023 are related to all members of the Council.
During the HJPV, the OBJANIN reminded that most colleagues did not think that the publication of the report is a good solution, and that the State Court filed an appeal to the BiH Constitutional Court.
In the continuation of the discussion, Duška Bogojević asked whether the deadline for applying for property could be proclaimed. Bogunić stated that, even in the event of the application, the property report will not be published within a month.
As the Detector clarified Demirel Delić, the head of the President of the HJPC, the Association of Judges and Prosecutors in BiH, launched an administrative dispute before the Court of BiH, seeking the laws of actions and processing of property cards.
In this proceedings, the State Court was requested to stop the administrative dispute and address the Constitutional Court to Amendments to the Law on the HJPC, relating to property reports and interests.
“The possibility of adopting an interim measure was announced in terms of suspending the implementation of the Law on HJPC BiH on the collection and processing of the report on the property, ie the public announcement,” Delić stated.
According to the amendments to the Law on the HJPC adopted in 2023. year, the property records are envisaged, which judges and prosecutors are obliged to submit. They have to state everything they own alone, but also all those with whom they live in a joint household.
Property reports and interests will be published on the website of the Council, with the aim of strengthening the integrity, transparency and confidence in the judiciary, and due to the prevention of the conflicts of interest and other unparalleled activities in the judiciary, the detector states.
The discussion on the publication of property cards was preceded by Sanin Bogunić for the President of the Council, during whose journalists, the proposal to the Council of Ministers was sent to extend the deadline of the audited state strategy for war crimes in three years.
