The working group for the development of a new Labor Law in the Federation of BiH should soon finish its job, and the draft would already be more precisely in August in advance before the FBiH Government.
Some are one of the most controversial newspapers that is expected to be the introduction of employment opportunities for half hours – a provision previously abused, especially in trade and catering sectors.
Workers fear that these practice, where they work full time, and their contributions are paid to the minimum basis, can be re-legal, while unions warn that this could become a rule, not an exception.
However, it is crucial what will bring a new Labor Law, will he be more favorable for workers, will they protect them?
From the Ministry of Social Policy and FBiH work for the factor, they are said to wait for the working group to complete the job, so they will see what further and how.
Fear of abuse
As things are currently standing in the new Labor Labor in the Federation of BiH, it should return a member to enable employers to employ workers for half hours.
Recall this possibility was available for employers a few years ago, so they used the employers abundantly using this legal possibility, especially those in trade and hospitality and hospitality, and workers worked full time.
The factor had the opportunity to talk to some of the workers who told the request for anonymity to fear this possibility because they had already had situations that they worked full time, and their contributions were paid for half hours.
– I’ve been working in a restaurant in a restaurant full time, eight, nine, and even more when I’m another shift, and the employer reports me about four hours. More Takao I don’t want to work and I hope I don’t have to – says Sarajka Sanela who has been working in catering for more than 20 years.
As an inquiry, why did not refuse that possibility then, and reported the case to the competent inspection, they answered that they needed a job and that the act would mean fire.
And the factor was the opinion on this he also sought from the representatives of the FBiH worker union.
Half-time problem and in developed countries
Mersiha Beširović, President of the Trade Workers in the Federation of BiH, says that we have a problem and countries in Western Europe, and that this is the problem of even scandinavian countries to boast of a high degree of social responsibility as well as strong union movement.
– The problem of part-time contract is one of the key problems in the trade sector – Besirović points out.
He says workers, especially women, unfortunately, cannot get a full-time contract and thus are burdened and when it comes to pensions, but also other benefits that workers with full-time contracts.
– I’m afraid that’s just waiting for us. Especially since our system is such that we find a way to abuse in everything. So fear exists – says Beširović, and says that it is on workers not to tolerate it.
– They don’t need to work full time if they’re logged in half-hours and I don’t believe it can be a problem. I think that as well as the wholesome I mentioned, I will have a problem that we will have workers on half of the workpooper as a practice, not the exception – claims – Besirović claims.
Away from the official version
Selvedin Štorović, President of the Independent Trade Union of BiH, for the factor points out that the working group involving the union in charge to prepare the text of the Pre-Draft of this Law.
-Dake, we are still far from some official version of the text that will be found in the public hearing. Of course, we don’t want to leave anything to the case and active in defining the most favorable solutions for workers and workers in the Federation of BiH to improve the work-legal, but also economic-social position – said TaTorovic.
He adds that, in terms of working hours, valid Labor Law (Article 36, paragraph 1) provides for the possibility of concluding a full-time or part-time contract.
– Such solutions are also present in other countries in the environment and the region. However, the fact is that in our employers, they often seriously know about us to abuse in a way that with a worker concludes an agreement with a part-time working time, and in practice that worker works full time, which directly represents work. I think that in such situations, inspection bodies should play a key role, whose capacity needs to be strengthened and which will establish all irregularities and sanctioning inconsistent employers – Tatorović points out.
Says that, workers who find themselves in such a position, have the opportunity to report to the competent inspections of irregularities to remain their rights that the law guarantees them, writes Factor.
– The Alliance of Independent Unions of BiH will seek to regulate this issue in the new Labor Law in the working group through the participation in the working group. We hope that in that intention, we will also have interlocutors in the representatives of the executive, but also the legislative authorities that publicly advocate the thesis that they will fight work closely – concludes Tatorović.
