The Service for Jobs with Foreigners “earned” is the opinion with a reservation of the institutions of Bosnia and Herzegovina due to irregularities and disadvantages in public procurement that consisted of last year.
In addition to this, the auditors have drawn attention to the payment of stimulation, a fixed-term work contract, as well as that some employees were performed without compensation.
One of the public procurements that the auditors have singled out is the one for the purchase of residence permit labels in Bosnia and Herzegovina. The contract is worth 48,000 euros, and the service did not respect its provisions given that it was contracted that the supplier from Belgrade would ship to Sarajevo, but employees of the service actually went to Belgrade on the label.
– As in the previous year, procurement costs are increased by employee travel costs – the Office for Audit of the Institutions of Bosnia and Herzegovina in Audit report.
Furthermore, they set aside the purchase of five specialized vehicles estimated values of 249,990 KM (49,998 KM per vehicle), insulting the existence of active and fair competition.
Namely, the service has conducted market research and collection of information offers, and the market price for what service asked for more than what they planned to pay, and yet they went with “their” price in a public call. The two offers arrived for the same model of the vehicle, with one for two km cheaper than the other, per vehicle. The contract was concluded with these cheaper, 249,975 km (49,995 km per vehicle).
– As the bidders offered the same brand and the members of the same distribution networks for the sale of vehicles in BiH, the practice shows that competitiveness in these cases does not exist from the e-auction themselves – auditors warned.
Interestingly, the contract concluded with the selected bidder “two days before the bidder was informed of the results of the procedure.”
When it comes to the payment of stimulation, the Foreign Affairs Service has exceeded the Fund. Stimulations did not exceed the allowed individual amount, but they were paid in a larger total amount of allowed.
– The stimulation fund in the service was 120,793 KM. Total paid gross stimuli in 2024. years amounted to 149,259 KM – the auditors specified.
Spores and the case without a competition, during the year, hired four employees through the work contract.
Attention was drawn and that the six employees performed the company’s second place of higher rank in relation to what they are employed, but without compensation.
– One civil servant performed the head of the head of the Director, while five higher expert associates performed jobs of vacancies of heads of head of field centers – written in the report.
It was warned that the consequence may be court disputes, keeping in mind that the lawsuits were already submitted. In one, 36,500 KM pays the pay difference.
– According to the submitted records, there are eight lawsuits in which the service is responded, and their value is 77,440 KM. In seven out of eight claims, prosecutors claim compensation for the differences of salary to perform another job.
The legal basis for lawsuits are the decisions of the Director of the Service that determined that civil servants perform the second level of higher levels without compensation. In the values most important request, the prosecutor claims the difference in paying the amount of 36,560 KM, in order to perform another workplace on the assembly’s order. The proceedings are underway and the first instance court decision requests that the Service, in addition to the payment of the difference, with legal tension interest, compensation and contributions for PIO and health insurance. The service has invested a regular remedy by which a decision has not yet been made – the auditors pointed out.
What was determined is that seven employees have progressed, but not because they have acquired a higher degree of titles but based on the equivalence of the previously acquired professional name, which cannot be the reason for progress.
