Many citizens are not familiar with the fact that when registering a vehicle that was the subject of probate, they must also submit a gift tax exemption certificate, and in some municipalities in Sarajevo Canton, the wait is longer because the FBiH Tax Administration does not have the required number of employees.
– Collecting documentation for the probate hearing is torture, but I didn’t know what awaited me after that when registering the vehicle. Namely, I went to register the car, and where I was told that maybe the Novi Grad Police Department would ask for a gift tax exemption certificate because the car was left by my deceased father.
That’s what happened. When I went to the Municipality of Novi Grad to collect the certificate, I experienced a cold shower. I was told that it won’t happen so soon, that it may take two or three months until I get a solution, because some commission has to carry out some kind of procedure there. Everything turned around for me because then the registration costs increase. The license plates must be changed, the vehicle must not be driven… Simply a shock – the reader told us.
We asked the Tax Administration of the Federation of Bosnia and Herzegovina to clarify how long citizens have to wait to receive a gift tax exemption certificate, which is necessary when registering a vehicle in cases where the vehicle was the subject of probate proceedings.
– The time of issuance of the Decision on inheritance tax exemption depends on the possibility of applying Article 22 of the Law on Real Estate Tax and Inheritance and Gift Tax, that is, on determining the order of succession. If Article 22 of the Law can be applied, tax offices on average issue decisions within two to 10 days. In cases where Article 22 of the Law cannot be applied, the procedure takes longer because it is necessary to carry out an assessment of the value of real estate and movable property by the municipal commission. After the Tax Administration receives the minutes of the commission, the issuance of the decision takes an average of seven to 10 days. The total duration of the procedure is additionally affected by the volume of requests being processed and the current staffing level in the tax offices – stated the Tax Administration of the FBiH.
