On the first-instance verdict of the Tuzla Cantonal Court, handed down in the repeated first-instance proceedings, by which in July 2025, Beriz Kabilović was sentenced to a prison sentence of 19 years, and Armin Halilović to a prison sentence of 6 years and 6 months, for the criminal offense of organized crime in connection with numerous other criminal offenses, the Prosecutor’s Office of the Republic of Turkey filed an appeal with the Supreme Court of FBiH against the imposed criminal sanction and a small part of the acquittal.
˝This verdict was not even based on the evidence obtained from the Sky application, but on numerous other pieces of evidence that the Prosecution presented at the main trial, and which the court appreciated when passing the verdict. Namely, at the suggestion of the Prosecution of the Criminal Code, during the year 2023, at the time of the main trial (trial), the Cantonal Court in Tuzla turned to the judicial authorities in France with a request to submit the data of the SKY communication used by the organizer of the group Beriz Kabilović, which the Prosecution learned about during the main trial. searches. Since then, almost two years have passed and the French judicial authorities have failed to deliver that evidence, said the spokesman of the TK Prosecutor’s Office, Admir Arnautović.
According to him, after the emergency, they were delivered only in 2025, and in addition to the communications, the order of the competent court in France was also requested, on the basis of which the data from SKY communication was collected from the server in France.
The French judicial authorities subsequently submitted part of the SKY communications in 2025, with very little information, while failing to submit the order itself.
˝As the legal term for the duration of detention and for the first-instance verdict was running out, the Tuzla Cantonal Court had a legal obligation to issue a first-instance verdict and could not wait for the delivery of the order from France. Therefore, it is not about any illegal evidence from the SKY application, but evidence that was requested and not delivered from France, which is why the court could not even appreciate that evidence when passing the verdict. But the most important thing to mention is that numerous pieces of evidence were presented in the case, and in the end, in the first-instance proceedings, the organizer was sentenced to 19 years in prison, and Armin Halilović to 6 years and 6 months in prison, Arnautović said.
