It is an amendment of Article 82. The Law on the PIO, which was adopted with the aim of protecting the fund from abuse, in cases of beneficiaries that do not reside in the Federation of BiH, and to ensure the protection of the Fund.
Namely, on this goal, on the basis of the ‘Old’ Law, the Rulebook that specified the conditions for exercising the right to the difference of the entity review of the pension to the lowest amount was adopted.
However, the Supreme Court of the Federation of BiH is a judgment from 12/12/2023. He determined that this issue could not be regulated by the Rulebook, but exclusively by legal.
In this regard, the Federal Ministry of Labor and Social Policy prepared amendment to the Law on the PIO, which, in addition to meeting the Court’s requirements, significantly affects the financial stability of the Fund.
Namely, the absence of this amendment has already caused the damage of 8 million KM, which further endangers the already overloaded Pension Invalid Insurance Fund and its increasing dependence on the FBiH budget. The Fund drank the budget user, and its financial plan is part of the Budget of the Federation of BiH from which significant funds are allocated each year to enable regular payments of pensions, is reasoned from the Ministry of Labor and Social Policy.
Pension payments directly depends on the financial stability of the Fund, and retirees, living on the edge of existence, must not be exposed to the risk of delay or endangering their income.
This change of law is therefore not only the prevention of abuse but also an expression for retirees, as well as responsibilities to the entire society, also stated the Ministry.
The Federal Ministry of Labor and Social Policy emphasizes that the issue of the Fund’s stability for the future of the Federation of BiH, and this changes are not only current generation of pensioners because a stable and functional pension system is the basis for the social security of all citizens of the Federation.
In addition to the Modification of the Law on Pio, the delegates to the House of Peoples adopted in the second of today’s session and the Law on Amendments to the Liability of Obligations on the Federation of Bosnia and Herzegovina. The essence of this act is the extension of the deadline until 31. 12. 2026. year for the process of regular verification of citizens’ claims on the basis of old foreign currency savings.
The Federal Government is a proposer and a third act, the Law, which is also adopted by the House of Peoples in today’s session, which granted the administrative allocation of the settlement of Brig in the area of the wide hill from the settlement wet. Thus, at the initiative of the citizens of the above area, the settlement Brig became a separate local community.
