The Central Election Commission of Bosnia and Herzegovina (CIK BiH) on today’s 39. The session adopted a decision to take the mandate to the President of the Republika Srpska, Milorad Dodik, after confirmed the final judgment of the Court of BiH.
This decision was adopted unanimously.
The CEC was previously requested by the sentencing to the Court of BiH, because without an official document, it cannot validly initiate the mandate confiscation procedure. After receiving the verdict, the Commission has a legal deadline of up to 15 days to act, while deadlines for up to 90 days are prescribed for early elections from the termination of the mandate.
Vehid Šehić, a former member of the CEC, confirmed that the procedure was launched immediately upon confirmation of the verdict and emphasized that if Dodik is the candidacy on the election list will not be allowed, and the CEC BiH will reject it.
Vehid Šehić warned that, even if Dodik refuses to accept the decision and implement the Court of BiH, it is possible to detain the legal consequences of the judgment.
Since Dodik on several occasions he hinted that he would not deviate from the position of the RS President, despite the final judgment, and as confirmed by an enchanted message on X-Koški on the eve of the CEC decision.
What is next now?
The CEC must be expected to decide on the termination of the mandate within the legal deadline;
After that, early elections for the RS President shall be issued, which must be held within a maximum of 90 days;
Dodik will no longer have the right to run for any political function until the expiration of a prohibition of six years.
Today’s CEC decision signifies the beginning of the official implementation of the Court’s final judgment, which Milorad Dodik was sentenced to the year in prison and six years of prohibiting political engagement. Electoral and legal mechanisms are initiated in accordance with the BiH Election Law and the CEC is expected to officially interrupt its mandate within the coming days, and organize early elections in the RS.
Recall, Dodik was remediently sentenced to a prison sentence of 1 (one) year, and the security of the President of the Republika Srpska President of the Republika Srpska was imposed on him for 6 (six) years. But Dodik can no longer perform any legal function.
