In the execution of this term, the OSCE not only has a responsibility, but also a duty to clearly and consistently declaring when the future of Bosnia and Herzegovina is endangered, Ambassador Aggeler pointed out.
According to him, this means condemnation of efforts aimed at understating the constitutional structures of the state through the establishment of parallel structures and prohibition of the work of institutions at the state level, which undermines the territorial integrity of BiH.
Aggeler recalls that the legal effect of these laws temporarily suspended the Constitutional Court of BiH, and that the participants and territorial integrity of BiH continues to undercover the jurisdiction of the state and the scope of the legal protection of individuals and legal entities in the Republika Srpska.
– Although the BiH Constitutional Court temporarily suspended the legal effect of some of these laws, the intention behind them is still deeply worrying. Justifications calling for return to the so-called “original” Dayton Agreement are deceptive.
State institutions established with the explicit consent of the entities – as prescribed by the BiH Constitution – are almost needed for the functioning of the state. After these institutions are established at the state level, their jurisdiction cannot be easily abolished or abolished. Neither the Constitution of BiH nor the transfer agreements do not contain provisions on their expiration or one-sided retreat. In the current constitutional framework, such unilateral moves are simply not legally permitted – warns the Head of the OSCE Mission to BiH.

– The secessionist and antiDeight rhetoric affects only the center of the institutional integrity of the state. Responsibility lies in BiH political leaders – to support the integrity of state institutions, to respect the Constitution and support the authority and independence of the judiciary – the Aggeler points out.
