The Court of Bosnia and Herzegovina has made a decision on custody for the President of the Republika Srpska Milorad Dodik, the Prime Minister of Republika Srpska Radovan Višković and the President of the National Assembly of the RS Nenad Stevandić, after being detained at hearing. The decision comes after not responding to the call for the hearing, resulting in the issuance of orders for their privacy at the request of the State Prosecutor’s Office. They are suspected of the criminal offense “attack on the Constitutional Order of BiH.”
Legal experts explain that the Court of BiH, in accordance with the legal procedure, will issue a decision on the interesting of the international warrant, which means that all countries in which the suspects will be found to extradite them, except those whose citizenship possesses. It is assumed that Dodik has the citizenship of Serbia, which means that Serbia will not be obliged to extradite it.
The BiH Investigation and Protection Agency (SIPA) confirmed that the Court of Justice of the Court of BiH received a request for assistance in the arrest, after which he conducted a security assessment and concluded that it was a high-risk procedure. Security analysts warn that possible conflicts of police agencies could further deepen the political crisis in the country.
Journalist and political analyst Ranko Mavrak assessed that the current situation carries a significant security risk and that the escalation could have incalculable consequences for the stability of Bosnia and Herzegovina. Also, Journalist Eldin Hajevović pointed out that, in the case of announcing an international warrant, Serbia had to react, because otherwise the pressure and sanctions of the international community could be exposed.
Meanwhile, Nenad Stevandić stayed in Belgrade yesterday, where he attended the event and expressed support “students who want to learn,”, which he published on social media.
In parallel with these events, the National Assembly of Republika Srpska adopted the Draft of the New Constitution of the RS, which will be sent to a public hearing, and the Proposal for the Protection of the Constitutional Organization, adopted by urgent proceedings. These decisions have caused numerous reactions, both in BiH and in international circles.
Jovan Kisin Kisin Kazin from Banja Luka Criticized the RS National Assembly, assessing that parliament ceased to be a legislature and became an executive authority that did not control the constitutionality and legality of decisions made. She warned that this situation endangers the democratic process, because the elected representatives behave on the principle of obedience instead of representing the interests of citizens.
The RS Constitution’s Constitution also reacted to the Office of the High Representative (OHR), as well as domestic officials, evaluating this move as an attack on the legal order of Bosnia and Herzegovina.
