The story of Nebojša Mraović, a doctor from Brc, in whose yard the remains of civilian victims of the war from the area of Srebrenica were found, has received a legal epilogue. However, the outcome is unexpected for many – the investigation will not be conducted due to the onset of absolute statute of limitations.
According to the available information, the competent prosecutor’s offices concluded that there are no legal conditions for further processing of this case.
Decision of the prosecutor’s office
The bones found in Nebojsa Mraović’s yard belong to victims of the Srebrenica genocide. The Prosecutor’s Office of Bosnia and Herzegovina was responsible for this case, but apparently, no one will be held accountable for this crime.
“The Prosecutor’s Office of Bosnia and Herzegovina issued an order that the investigation will not be conducted due to the occurrence of an absolute statute of limitations, and then the case was handed over to the Prosecutor’s Office of the Brčko District of Bosnia and Herzegovina, which, after analyzing its local jurisdiction and the temporal validity of the law, reached the same conclusion and decision,” the explanation states.
Reactions of families
From the Association of Families of Missing, Forcefully Taken and Murdered Bosniaks of Brčko District, they believe that this decision of the Prosecutor’s Office is shameful.
The president of the Association, Sead Golić, said that he believes that this outcome represents a serious failure of the judiciary.
“I think this is inexcusable for the BiH Prosecutor’s Office. May they be honored! They no longer deserve to conduct such proceedings. According to the Law on War Crimes, such cases do not expire. This is also a war crime,” said Golić.
Filed complaint
Nebojsa Mraović’s ex-wife also filed a complaint against the prosecutor’s decision. It should be decided by the chief prosecutor of the District Prosecutor’s Office, who has not yet been elected. This means that the decision on this legal remedy will probably be a long time coming.
Attorney Darko Milićević explained the reasons for submitting the complaint.
“By the very filing of the complaint, it is clear that we believe that the first-instance decision, that is, the order to suspend the investigation, is not correct. We request that the second-instance body in the Prosecutor’s Office review the regularity and legality of such a decision,” Milićević said.
Controversies related to the practice
Regardless of everything, Nebojša Mraović never stopped working in another practice in Brc.
Moreover, in December 2024, the Medical Chamber of the Republika Srpska issued him a license for five years to perform professional activities as an orthopedic specialist. However, it does not end there. By the Court’s decision, Mraović was also allowed to return to the property, that is, to enter the business premises of the surgery where he worked before the discovery of the buried bones, which is owned by his ex-wife.
His ex-wife Neda Mraović expressed her dissatisfaction with such a decision.
“They take possession of a man who does not exist in the company’s papers. They return him to the business premises, and they do not know what he will do there. He can only disturb and stay as he sees fit,” said Mraović.
No liability
Thus, the case of finding the remains of the victims of the Srebrenica genocide in the yard of a doctor in Brc was ended without an investigation and without determining responsibility. For the families of the victims, another question of justice that remains unanswered.
