The main hearing in the case against Ahmed Kastrati, accused of the murder of Saša Vilušić, began in the Cantonal Court in Tuzla on Wednesday. The witnesses described the event, while the court expert explained the type and origin of severe head injuries, evaluating the death as “murderous”.
The Prosecutor’s Office of the Tuzla Canton charges Ahmed Kastrati with the murder of Saša Vilušić in Tuzla. According to the prosecution, he is accused of hitting Vilušić in the head with a closed fist on June 21 last year, around 1:30 a.m. in a restaurant in Tuzla.
Vilušić later, as a result of his injuries, died on July 10 at the University Clinical Center in Tuzla, and after an earlier hearing on the plea, which Kastrati denied, the main trial began today in the Cantonal Court.
At the very beginning, the acting prosecutor read the indictment, stating, among other things, that Kastrati gave Vilušić a practiced kickboxing blow in the head area, from which the injured party immediately lost consciousness and subsequently died.
On the other hand, the defense of the accused disputes all the descriptions of the indictment, especially the part where it is mentioned “a practiced kick boxing blow in the head” because, as Kastrati’s legal representative said, there is no objective evidence for this.
The accused Kastrati also addressed the court, who, among other things, expressed his condolences to Vilušić’s family, stressing that he had no intention of killing anyone.
“The tongue can lie, but the eyes can’t. I didn’t want to kill anyone, I didn’t have that intention and it’s very difficult for me to deal with this,” Kastrati said.
During today’s main hearing, several witnesses were heard, as well as the court expert, that is, forensic medicine specialist Vedo Tuco, who said, among other things, that Vilušić suffered fatal head injuries during the incident.
Basing his statement on the medical documentation, Tuco stated that the head injuries were caused by a single act of action, and caused life-threatening damage to brain centers.
He also emphasized that Vilušić also developed pneumonia, judging that ultimately in this case it was a “murderous death”.
In addition to Tuca, several witnesses to the events proposed by the TK Prosecution were heard. In all the statements, two men, a certain AO and AB, were mentioned that evening together at the bar, with whom Vilušić had a verbal argument, and then a physical attack.
Among the witnesses was Vilušić’s longtime friend AH, who spoke about the fateful dinner in a restaurant in Tuzla. He pointed out that they came to the building between 23:15 and 23:20, stressing that the accused Kastrati was also in the company of certain AO and AB.
A little after midnight, according to witness AH, there was a small discussion between AO, AB and Vilušić, after which Vilušić went towards them, especially AO, to apologize.
“Saša told him to make up, he gave him a finger. Saša hooked him there, after which Ahmed threw a punch, and then Saša fell. I saw that blow because I was standing on his right, while Ahmed was on the left. First he grabbed him by the shirt, pulled him back and hit him with his left closed fist in the area of the left side of the head,” said witness AH
He also stated that Vilušić immediately fell unconscious, and that apart from him, AO and AB came to his aid and then moved away. Other witnesses as well as AH said that the accused Kastrati did not come to help Vilušić, and when the police arrived at the scene, he was not inside the building.
Vilušić’s father Tomislav was also heard today, who said that he joins the criminal prosecution of Kastrati, but also that he is seeking compensation for damages, while the amount will be submitted to the court later.
