The Supreme Court of FBiH, ruling in the appeal proceedings in the criminal case against Mika König, for complicity in the murder, made a decision rejecting the appeals of the cantonal prosecutor from Tuzla and the defender of the accused as unfounded, so the judgment of the Cantonal Court in Tuzla, in the part in which the accused was sentenced to 14 years in prison, is confirmed.
In connection with the appeals, ex officio, the judgment of the Cantonal Court in Tuzla was changed in the decision on crediting custody, so that the time spent in custody from 07.07.2023 should be included in the sentence imposed on the accused. year, until sent to serve the sentence. The rest of the first-instance judgment remains unchanged.
By the verdict of the Cantonal Court in Tuzla, the accused was declared guilty of having on 16.06.2015. in the time from 12:00 to 1:30 p.m., at a remote location in the village of Bašigovci near Živinice, together with his brother Zarif Seferović, according to a previous agreement, with the actions described in detail in the sentence, made a joint decision to kill his brother’s wife SS, in such a way that one of them fired three bullets in her direction, causing her injuries that resulted in the death of the injured party. After that, both of them drove away from the scene, leaving her lifeless body at the place of execution.
Previously, by the judgment of the Cantonal Court in Tuzla dated March 27, 2017. year, which is legally binding according to the judgment of the Supreme Court of FBiH dated September 7, 2017. for complicity in the same criminal act, Zarif Seferović was sentenced to twelve years in prison.
