In the Federation of BiH, the previous way to deliver the penalties for improper parking and other offenses through vehicles has changed amendments to the Law on FBiH violations and adopted both homes of the Federal Parliament.
More precisely, the Law on Amendments to the Law on Misdemeanors of the Federation of BiH, which improved the legal solutions and their harmonization with the decisions of the Constitutional Court of Bosnia and Herzegovina was adopted at the session 4. March and entered into force 15 days ago.
Adopted amendments to Article 56. Law, as clarified for Reportthe practice of leaving misdemeanor orders in the visible place on the vehicle has been completely abolished.
Deleted J The formulation that allows attachment to the vehicle, which means that the police of misdemeanor orders will be submitted in other ways. And the other way is personally or by mail.
According to the new provisions, “Penalties for improper parking will be able to be presented exclusively in person or by mail,” the law amended.
In Article 56. Law clearly: (Delivery of the misdemeanor order).
(1) The misdemeanor shall consist of the original and at least two copies. The original reserves an adopted organ in his records. Two copies are served by the defendant.
(2) The misdemeanor order may be presented to the defendant’s personal handling or mailing.
Paragraph 3 was ejected. Of this law stood.
“Attaching or leaving a transaxing order in a secure and visible place on a motor vehicle if an offense is committed to the improper parking of the motor vehicle.
In addition, in Article 75.Stoji (the handing of the solution)
The Court will present a copy of the decision on the misdemeanor of personal handling or by mail the defendant and authorized authority or injured within five days from the date of decision on the offense.
The proposed changes remove the rule according to which delivery was considered five days after the solution was committed to the post office.
