The law provides for increased transparency, stronger regulatory role of FERK, and special government measures in the event of market disorders, which forms an important step towards the modernization of the FBiH energy sector.
“The House of Representatives of the Federation of Bosnia and Herzegovina adopted the Law on Federation, Distribution, Storage and Natural Gas Law. This Law aims to protect the interests of end consumers, strengthening energy security and environmental protection in the The context of the use of natural gas “, the Federal Minister of Energy, Mining and Industry Vedran Lakić pointed out.
He added that the law plays a key role in the design of energy policy, the introduction of effective regulation, the implementation of the legal framework, the introduction of new rights and mechanisms for the protection of end customers of natural gas and the development of gas infrastructure in the Federation of BiH.
Its adoption is an important step towards harmonization with European Union standards, a reduction of dependence on fossil fuels, encouraging market competition, increasing transparency and protection of consumer rights.
Special attention is paid to the division of jurisdiction between the institutions of Bosnia and Herzegovina and the entities, in order to include exclusively issues within the competence of the Federation of BiH, including production, distribution, supply and gas storage. Also, the Law contains provisions confirming the commitment of the Federation of BiH for the adoption of regulations in the natural gas sector and at the level of Bosnia and Herzegovina.
– The proposed legal solution is introduced by the regulation of the natural gas sector from FERK, which will improve the functioning of this sector, and especially protection of citizens’ rights as end customers. Mechanisms that ensure that the Ministry and FERK are continuously monitored by the work of entities in the natural gas sector and take measures to strengthen the security.
As an additional mechanism for protection of security security, the law prescribes the possibility that the Government of the Federation declares the state of endangered supply of supply, insufficient supply of natural gases, a sudden market price or other circumstances that endanger the stability of supply. In such situations, the Government may introduce special measures to control and form prices to mitigate the consequences of market disorders to end customers.
The draft law should also confirm the House of the Peoples of the Federation of BiH, the Federal Ministry of Energy, Mining and Industry was announced.
