Therefore, the deadlines for reporting property for the year 2023 were invalidated after the Agency for the Protection of Personal Data of Bosnia and Herzegovina passed a decision that the data cannot be processed until the establishment of a functional Department for the implementation of procedures based on reports.
After the members’ discussion about the meaning of the term functional Department, Demirel Delić from the Department for Legal Affairs said that it cannot be determined that the Department is functional without the person who heads the Department.
– At the moment, we do not have a functional Department on any basis, the Council should decide on this matter soon – underlined Delić.
As a reminder, in November 2023, with the adoption of the new systematization of positions, the HJPC practically formed a new Department for the implementation of the procedure for verifying reports on the assets of candidates for judicial positions – which was foreseen in earlier amendments to the Law on the HJPC, but has not yet been appointed head of the Department.
The President of the HJPC, Halil Lagumdžija, proposed a conclusion in which the Council undertakes that, after the head of the Department is appointed and a certain number of positions are filled, it will consider whether the Department is functional and then make new conclusions about the submission of reports on the assets of judges and prosecutors.
Also, the point was accepted today, ordering the Council to ensure adequate technical and organizational data protection measures from the report on assets and interests, and to revise the Personal Data Security Plan in the HJPC in this context.
Lagumdžija proposed the conclusion that the reports that have already been submitted electronically should be deleted, and those submitted by mail should be returned, and that the report submitters should be informed about this.
At the session, the Draft Plan for the fight against corruption of the HJPC 2024-2028 was adopted, reports BIRN BiH.
