The Cantonal Court in Tuzla, in the first-instance criminal proceedings against Salim Kovačević (35) from Mirčina near Gračanica, issued and publicly announced a non-final verdict in which the accused was found guilty of the criminal offense of Causing death by negligence under Article 168 of the Criminal Code of the Federation of Bosnia and Herzegovina, and sentenced him to one year in prison.
The accused was found guilty that on January 11, 2025, around 2:00 a.m., after a verbal conflict with Senad Smajić (66) from Miričina in a restaurant in Gračanica, in the parking lot in front of the facility, where there had previously been a physical conflict with several guests of the said facility who inflicted blows on the injured party from which he suffered minor injuries, although he was not aware of the possibility that the victim could be killed, but according to all the circumstances he was obliged and could be aware of this possibility, struck the same person with his knee in the stomach area, after which they both fell to the ground, during which Smajić hit the back of his head on the asphalt-concrete surface, and received a serious and life-threatening bodily injury, of which the injury occurred on 15.01.2025. died in UCC Tuzla.
The time spent in detention from January 17, 2025 shall be included in the sentence imposed on the accused. until 28.10.2025. year.
The court obliged the accused to pay sums of 30,000 KM for four members of the victim’s family as compensation for non-material damages due to mental pain caused by the death of a close relative within thirty days from the date of finality of the judgment under the threat of enforcement.
