January 9 – from the circus to dangerous threats and intentions. Year after year, Republika Srpska defies the decisions of the Constitutional Court of Bosnia and Herzegovina. By celebrating the unconstitutional day of the RS, violations of the Criminal Code of Bosnia and Herzegovina are also being violated. Competent institutions passively observe, react slowly and inadequately.
The song died down, the parade passed, the demonstration of force in the streets ended, but the messages remained. Hosts and guests, united in denying BiH. Served in Banja Luka, aimed at Sarajevo. What a celebration, such messages. Scandalous, provocative and threatening. On the ceremonial stage, on behalf of Milorad Dodik and in his defense from the Court of Bosnia and Herzegovina, the Minister of Internal Affairs of the RS, Siniša Karan, appeared. With an ultimatum: freedom for Dodik or the end of BiH.
“This court case is a dividing line for and against Serbian survival. It is the dividing line between our friends and those of others. After the end of the procedure, it will be known whether the Dayton Agreement and BiH will survive,” said Karan (SNSD).
The guests from Serbia also made an effort. And they brought only threats and dubious intentions to the ceremony.
“BiH is not the guarantor of RS, i.e. Serbia, but Serbia is the custodian of the internationally recognized Dayton Agreement, so don’t teach us where to come, how to come and when to come,” said the Deputy Prime Minister of the Government of Serbia, Aleksandar Vulin, with the message that ‘with them it should be nice, and even better with the RS’ and that there is ‘no better neighbor than Serbia’.

“You have Karan, who based his platform on secession, on the platform of the All-Serbian Parliament. Therefore, the implementation of what was agreed upon at the All-Serbian Parliament, which is some kind of framework of the ‘Serbian world’, is ongoing. You had Vulin who has two messages. One is that the RS is above BiH and that the control package of life in BiH is actually in the hands of Serbia, which is complete nonsense. All the messages are expected, all the messages are ultra-nationalist”, says journalist Dragan Bursać.
“You see that these are messages that are consistent, that are constant and that should be taken seriously because, if we say that it’s just a circus, then I’m afraid that one morning we may wake up surprised by what happened. So, on the one hand, yes, it’s literally a circus because, I repeat, we haven’t heard anything new, nothing spectacular that we haven’t heard before,” psychologist Srđan Puhalo believes.
And, for years we have been hearing various threats of secession. The speakers change, but not the goal. Behind the parade on January 9, there is a lot of material for judicial institutions. In the Federation, numerous reactions and calls to the Prosecutor’s Office to finally react, stop the practice of marking an unconstitutional day and punish those responsible.
“I believe that all these people who were there and the organizers had to be arrested. Unfortunately, we still do not have such strong institutions that should implement the decisions of the Constitutional Court”, said FBiH Vice President Igor Stojanović (SDP).
“By not undertaking its legal obligations, the Prosecutor’s Office becomes an accomplice in the RS regime’s attack on the constitutional order of Bosnia and Herzegovina and the commission of a criminal offense related to non-implementation of the decisions of the Constitutional Court of Bosnia and Herzegovina,” said the SDA.
Although slowed down, the Prosecution is working. Activities to organize and mark the unconstitutional day of the RS are ongoing.
“At the Prosecutor’s Office of Bosnia and Herzegovina, at the beginning of 2024, on the basis of a received application from a natural entity, that is, a citizen, a case was formed in which a prosecution team of a total of four prosecutors is acting. Information was requested from the Constitutional Court of Bosnia and Herzegovina and an order was sent to the State Agency for Investigations and Protection to carry out certain actions and checks. When the prosecutor’s decision is made, the public will be informed”, the statement of the Prosecutor’s Office of BiH states.
In this year, there are no registered reports, so far no criminal liability has been established for non-execution of the decisions of the Constitutional Court of Bosnia and Herzegovina.
“There is no judicial practice in this direction and there is one failed attempt to prosecute the members of the Working Commission that organized the referendum on January 9 as the day of the RS. It is obvious that at this moment, the BiH Prosecutor’s Office has neither the will nor the knowledge to appropriately prosecute the perpetrators of this criminal act,” claims Harun Išerić, senior assistant at the UNSA Faculty of Law.
Faster than the Prosecutor’s Office is the reality to which the celebrants on both sides of the Drina woke up today. Their show has an expiration date. After song and noise, tell the facts. BiH always survives and remains. And the allies in the secessionist idea are squeezed by the ring of sanctions and the torture of the accused bench.
