Fikret Hodžić released in the repeated procedure in the “Respirators” case

The Court of Appeals of the Court of Bosnia and Herzegovina published a second instance verdict, which in the proceedings in the procedure rejected the charges of Fikret Hodžić and the legal entity “FH Srebreni raspberry”.

The trial of Hodžić was renovated before the Council, after the Constitutional Court, the Judgment of the Court of BiH was sentenced to five years in prison for abuse of position, and found that it was violated to a fair trial.

The decision of the Appellate Panel states that this decision is causally related to the circumstance that certain legal qualifications in this criminal matter are in a presiding criminal offense that the Prosecution in BiH has been charged with the accused.

“On the other hand, in terms of criminal offense of the abuse of position or authority, the decision to refuse the accusation is the result of the full implementation of the BiH Constitutional Court, and respected standards established by such a decision,” said in a statement from the Court of BiH.

The Appellate Panel concluded that the legal qualification must always clearly arise from the description of the accused, which should be borne by the accused in the investigation records, which precede the indictment.

“In the concrete, the accused were examined in the previous proceedings, and in the manner specified in the indictment, however, it is presented to them, it does not contain, as well as that Hodžić and his firm are not facing the accusation in the correct manner.

The Trial Judgment of the Court of BiH, except Hodžić, was also convicted of the former Federal Prime Minister Fadil Novalić, and the director of the Federal Civil Protection Administration, while the former Minister of Finance Jelka Milicevic was released.

The renewed trial of Hodzic began at the end of January.
